ALCOHOL AND DRUG TESTING PROGRAM

Health Index, Inc. has established and maintained a program designed to help prevent accidents and injuries resulting from the misuse of alcohol and controlled substances by drivers of commercial vehicles.

REQUIREMENT TO GIVE NOTICE

382.601 Prior to performing an alcohol or controlled substance test, each employer shall notify a driver that the alcohol or controlled substance test is required. Each employer shall provide educational materials that explain the requirements of alcohol and controlled substance testing.

Health Index, Inc. shall distribute and post educational materials to advise your company drivers of testing prior to the actual test dates, as well as notify the representative of your employees organization.

382.601

Employer obligation to promulgate a policy on the misuse of alcohol and the use of controlled substances.

Health Index, Inc. shall develop your company's policy statement concerning the misuse of alcohol and controlled substances by drivers.

TRAINING OF SUPERVISORS

382.603 Employer shall ensure that persons designated to determine whether reasonable suspicion exists to require a driver to undergo testing, receive at least 60 minutes of training on alcohol misuse and receive at least 60 additional minutes of training regarding controlled substances.

Health Index, Inc. offers qualified instructors to train your company supervisors for signs and symptoms recognition of alcohol and controlled substance misuse and the proper manner in which to document such signs and symptoms.

REFERRAL, EVALUATION AND TREATMENT

382.605 Drivers who have engaged in prohibitive conduct shall be advised by the employer of the resources available to the driver in evaluating and resolving problems associated with the misuse of alcohol and controlled substances: names, addresses, telephone numbers of substance abuse professionals, counseling and treatment programs.

Drivers who engage in prohibitive conduct shall be evaluated by a substance abuse professional (S.A.P.).

Before a driver returns to duty after engaging in prohibitive conduct, the driver shall undergo a return to duty alcohol or controlled substance test.

The driver shall be evaluated by a substance abuse professional to determine whether the driver has properly adhered to a rehabilitation program.

The driver shall be subject to unannounced follow-up alcohol and controlled substance testing administered by the employer following the drivers return to duty. The number and frequency of such follow-up testing shall be as directed by the substance abuse professional, with a minimum of six tests within the first 12 months.

Evaluation and rehabilitation may be provided by the employer, by a substance abuse professional under contract with the employer, or by a substance abuse professional not affiliated with the employer.

The employer shall ensure that a substance abuse professional who determines that a driver requires assistance in resolving problems with alcohol misuse or controlled substances does not refer the driver to a substance abuse professional from whom he receives remuneration or has a financial interest.

Health Index, Inc. shall provide referrals to numerous counseling services, substance abuse professionals and treatment programs. Health Index, Inc. shall serve as your company's substance abuse professional. Health Index, Inc. is available to perform all alcohol testing and controlled substance testing on a 24 hour, 7-day per week basis.

382.409 A Medical Review Officer (MRO) shall maintain all dated records and notification identified by the tested individual for a minimum of five (5) years for verified positive alcohol and controlled substance tests.

Health Index, Inc. shall provide your company with a Medical Review Officer and shall maintain your positive test results for five (5) years.

382.105 Employer shall ensure that all alcohol or controlled substance testing be conducted:

Health Index, Inc. shall provide on site 24-hour, 7 day per week testing for both alcohol and controlled substances.

382.401 Employer shall maintain records of its alcohol misuse and controlled substance use prevention programs.

Health Index, Inc. shall develop and maintain your company's records for misuse and prevention of alcohol and controlled substances.

382.403 If an employer is notified by the Federal Highway Administration (FHA) to report the employer's annual calendar year summary information, the employer shall prepare and submit the report to the Federal Highway Administration.

Health Index, Inc. shall prepare this report for submission to the Federal Highway Administration.

382.405 Access to facilities and records

Health Index, Inc. shall instruct your company's staff on how and who may receive individual testing records.

391.41 Physical qualifications of drivers

Health Index, Inc. maintains physicians on staff and shall provide physical examinations on site for your drivers.

Health Index, Inc. utilizes the services of Lab One's NIDA Laboratory for all Department of Transportation urine drug testing.

Health Index, Inc. upon receipt of urine drug test results shall give a verbal report to the designated employer representative. A hard copy shall follow by mail. Most negative urine drug test results shall be reported to the identified employer representative within 24 hours of collection.
